Gtld Advisory Services

A generic top-level domain name (gTLD) is the part of a domain name (or internet address) that identifies and associates it with a particular domain class, such as “.com,” “.org” or “.net.” These domain names are regulated by the Internet Corporation of Assigned Names and Numbers (ICANN), which reviews applications for new gTLDs. As a result of new gTLDs constantly being reviewed and approved, trademark holders must implement a strategic plan to monitor gTLDs for possible infringement.

This is where our attorneys come in. ESQwire.com can help you understand gTLD and formulate a customized strategy to reflect and protect your brand and market. Specifically, our attorneys:

  • Evaluate brand protection strategies;
  • Review new gTLDs and provide analysis regarding any implications they may have to your brand;
  • Prepare domain name enforcement strategies regarding new gTLDS;
  • Register domain names in new gTLDs for your brand; and
  • Engage in dispute resolution and litigation concerning any infringing domain names.

The current gTLD landscape presents challenges to brand owners, who now need to be increasingly diligent about monitoring the marketplace for abuse, fraud, and new legal complications. Furthermore, new gTLD rules impact the internet as well as all of the businesses that depend upon it, especially when it comes to brand representation.

How We Can Protect Brand Owners

Given the constant registration of new gTLDs, you and your attorney should consider registering your trademark with the Trademark Clearinghouse, which allows you to be notified whenever a third party files an application to register a domain name that is identical to one already registered with the Clearinghouse. At the same time, the third party seeking to register that name is provided with a warning that it is already registered. In order to register, you and your attorney submit proof of ownership of the trademark, proof of its use in commerce, and the applicable registration fees.

Another option is to file a Uniform Domain Name Dispute Resolution Policy (UDRP) claim with the Internet Corporation of Assigned Names and Numbers (ICANN), challenging a registered domain name with a new gTLD. If you prevail under ICANN, pursuant to the UDRP, the domain name is transferred or cancelled.
