A generic top-level domain name (gTLD) is the part of a domain name (or internet address) that identifies and associates it with a particular domain class, such as “.com,” “.org” or “.net.” These domain names are regulated by the Internet Corporation of Assigned Names and Numbers (ICANN), which reviews applications for new gTLDs. Given the constant registration of new gTLDs, you and your attorney should consider registering your trademark with the Trademark Clearinghouse, which allows you to be notified whenever a third party files an application to register a domain name that is identical to one already registered with the Clearinghouse. At the same time, the third party seeking to register that name is provided with a warning that it is already registered. In order to register, you and your attorney submit proof of ownership of the trademark, proof of its use in commerce, and the applicable registration fees.

Another option is to file a Uniform Domain Name Dispute Resolution Policy (UDRP) claim with the Internet Corporation of Assigned Names and Numbers (ICANN), challenging a registered domain name with a new gTLD. If you prevail under ICANN, pursuant to the UDRP, the domain name is transferred or cancelled.
